【摘要】:ThisInternationalStandardprovidesguidanceondataprotectionrequirementstofacilitatethetransferofpersonalhealthdataacrossnationalborders.Itdoesnotrequiretheharmonisationofexistingnationalstandards,legislationorregulations.Itisnormativeonlyinrespectofinternationalexchangeofpersonalhealthdata.Howeveritmaybeinformativewithrespecttotheprotectionofhealthinformationwithinnationalboundariesandprovideassistancetonationalbodiesinvolvedinthedevelopmentandimplementationofdataprotectionprinciples.TheInternationalStandardcoversboththedataprotectionprinciplesthatshouldapplytointernationaltransfersandthesecuritypolicywhichanorganisationshouldadopttoensurecompliancewiththoseprinciples.Whereamultilateraltreatybetweenanumberofcountrieshasbeenagreede.g.theEUDataProtectionDirective,thetermsofthattreatywilltakeprecedence.ThisInternationalStandardaimstofacilitateinternationalhealth-relatedapplicationsinvolvingthetransferofpersonalhealthdata.Itseekstoprovidethemeansbywhichdatasubjects,suchaspatients,maybeassuredthathealthdatarelatingtothemwillbeadequatelyprotectedwhensentto,andprocessedin,anothercountry.ThisInternationalStandarddoesnotprovidedefinitivelegaladvicebutcomprisesguidance.Whenapplyingtheguidancetoaparticularapplicationlegaladviceappropriatetothatapplicationshouldbesought.Nationalprivacyanddataprotectionrequirementsvarysubstantiallyandcanchangerelativelyquickly.WhereasthisInternationalStandardingeneralencompassesthemorestringentofinternationalandnationalrequirementsitneverthelesscomprisesaminimum.Somecountriesmayhavesomemorestringentandparticularrequirementsandthisshouldbechecked.
